Strict Order of Hon’ble Supreme Court to Odisha Govt, In case of recruitment of special educators, to file affidavit within two weeks

Hon’ble Supreme Court in a public hearing case W.P. (C) 132; 2016 on 28/10/2021 passed a judgment ordering the appointment of one special teacher in each general government school in each state and union territory. But unfortunately the government has not yet appointed any special teacher
Again the Hon’ble Supreme Court heard this case on 21.07.2022 and ordered that one special teacher for every 10 Differently abled students in primary schools and 1 teacher for every 15 Differently abled students in higher primary, secondary and higher secondary schools. It has decided to appoint a special teacher and if there is even one disabled child in a school then a special teacher is mandatory.
The Ministry of Education of the Central Government has also amended the Right to Free and Compulsory Education Act 2009 (RTE Act 2009). According to this law, the ratio of one special teacher for every 10 Differently abled students from first to fifth class and one special teacher for every 15 Differently abled students from sixth to eighth class has been made mandatory. It is mandatory to have at least one special teacher in a school but the government has not taken any action in the recruitment process, whereby a Concept Petition (Civil) 591/2022 was filed on 25 August 2022.
Today i.e 15/02/2023, the bench of Honorable Justice Dinesh Maheshwari and Justice Sanjay Kumar of the Supreme Court heard the above contempt of court case for 25 minutes and expressed great displeasure. and number of children with special needs in all states, number of registered special teachers, number of vacant posts, number of contract teachers and number of temporary teachers actually working/number of special teachers, filling up the posts as per the prescribed time limit and as per orders dated 28 October 2021 and 02 May 2022 The proposal to fill the post has been asked to be prepared and an affidavit submitted within two weeks.
The Odisha Special Educator Federation for Divyang (OSEFD), an association always striving for the development of education CWSN students, has claimed that if the order of the Hon’ble Supreme Court is complied with, around six thousand aspiring special teachers of Odisha will benefit from recruitment.
