The Supreme Court of India has reduced the sentences of two convicts in an NDPS case to the period already undergone, directing their immediate release if they are not required in any other case. A Bench comprising Justice Aravind Kumar and Justice Vipul M. Pancholi passed the order on October 8, 2026, in Ramsunder Chouhan & Anr. v. State of Chhattisgarh. The appellants were convicted under Section 20(b)(ii)(B) of the NDPS Act in a case involving 19.100 kg of ganja allegedly in joint possession. While upholding their convictions, the Court observed that the seized quantity was below commercial quantity and held that their incarceration of two years and one month was sufficient. Accordingly, the Court modified the three-year sentence imposed by the Chhattisgarh High Court to the period already undergone, allowing the appeals in part. Mr. Snehasish Mukherjee, Advocate-on-Record, and Mr. Maneesh, Advocate, appeared for the appellants before the Supreme Court.
